A federal rule has governed how funerals are sold since 1984, and it is stronger than most people realize. A provider must hand over an itemized written price list at the start of any in-person discussion of arrangements, and it is yours to keep. They must quote prices over the telephone to anyone who asks, without requiring a name. They must show a casket price list before showing caskets. They cannot require a casket for a direct cremation, and must make an alternative container available. They cannot refuse a casket bought elsewhere or charge a fee for handling it. Embalming cannot be described as legally required when it is not.
Every one of those provisions concerns what happens once you are in the building or on the phone. None of them requires a funeral home to publish a single price anywhere a person could see it before making contact. That is the whole gap, and it is the reason the prices behave the way they do.

Editor's Note: Once named the #1 stock picker by TipRanks, Luke Lango has identified 40 stocks before they soared by 1,000% or more. Today he's giving away his #1 investment to play the booming space economy, free. Click here to get the name or ticker or read more below.
Dear Reader,
I want to give you a free stock pick today.
No strings attached. No credit card required. Just the name, ticker, and my full analysis.
Here's what I can tell you right now:
The space economy is exploding...
Elon Musk recently filed with the FCC to launch up to million orbital data centers.
Anthropic and Google are teaming up with him to make this happen.
And Jeff Bezos is quickly becoming one of his biggest competitors.
But if you want to profit from this shift, you don't want to own SpaceX, Bezos' Blue Origin, or anything like that.
You have to own this investment.
I've recommended 39 stocks that soared by 1,000% or more.
Including 3,945% on Axon Enterprises...
12,097% on GameStop...
And 26,797% on Advanced Micro Devices.
That's enough to turn a $1,000 stake into more than $260,000.
This space investment could be another big winner.
But it's just the beginning...
I've identified three additional stocks in this industry that could see 1,000% gains or higher starting in the coming weeks.

What Happens When Prices Are Itemized but Not Published
Comparison shopping under these conditions means telephoning several funeral homes individually, in the days after a death, and asking each for figures. The regulator tested how well that works. In an undercover sweep of 278 randomly selected providers reported in November 2024, about a quarter could not provide prices after business hours, roughly half gave estimates or ranges rather than actual prices, at least a third gave package pricing with no itemization, and at least 37 providers quoted different prices for the same services on different calls. A separate survey found more than 60 percent of funeral home websites carrying little or no price information.
The result is the spread. Direct cremation, which is a standardized service with little room for variation in what is actually done, runs in a typical national range of roughly 800 to 2,500 dollars, but inside a single metropolitan area the range is far wider: industry pricing data puts New York City from under 500 dollars to over 10,000, Houston from about 795 to 6,570, Chicago from about 1,295 to 4,600. Undercover shoppers in one city found embalming quoted between 350 and 995 dollars, hearse service between 195 and 565, and the identical oak casket between 1,010 and 5,085.
The Mechanics of a Purchase Made Under Time Pressure
Those spreads survive because of when the purchase happens. Almost every other large transaction a household makes allows time: a car, a roof, a mortgage. This one is made within a day or two of a death, usually by someone who has not slept, often by the family member who happens to be nearest, and typically at the first provider called because calling a second feels like haggling over a parent.
The rule's telephone provision is designed precisely for that moment, and it works when used, but using it requires knowing it exists and being willing to make four calls on the worst morning of the year. Consolidation raises the stakes: about a quarter of the roughly 15,400 funeral homes in the country are corporately owned, and the largest operator runs nearly 1,500 funeral locations and 500 cemeteries under a range of consumer-facing brand names that do not carry the parent company's name, so a family calling three homes may be calling one company three times.
The Review That Has Not Reported
The regulator opened a review of the rule in November 2022 asking whether to require online price disclosure, took comments, held a workshop in September 2023, and has issued nothing since. Online posting remains voluntary everywhere, and no state has made it mandatory.
Where Prepaying Does and Does Not Help
Buying in advance removes the time pressure, which is the single biggest source of overpayment, and for that reason it genuinely helps. What it does not do is put the money somewhere federally protected. A prepaid contract is funded either through a state-regulated trust or by a life insurance policy assigned to the funeral home, and state trusting requirements range from about 30 percent of what you paid to 100 percent, the remainder being the provider's immediately. Whether today's price is guaranteed, whether the contract can be moved to another provider, and what happens if the home is sold or closes are all contract terms and state law rather than federal rights. The consumer agency's own guidance says plainly that protections vary widely and some state laws offer little effective protection.
The law guarantees that you will be told the price, and guarantees nothing about being able to learn it before you are sitting in the room where you will be asked to decide. The two things that change the outcome cost nothing: request the general price list by telephone from three providers before choosing one, which they are required to give, and if prepaying, get in writing what share of the money goes into trust, whether the price is guaranteed, and whether the contract transfers to another home.
